How we collect, use and protect your data in accordance with the UK GDPR and the Data Protection Act 2018.

Who we are

Party Wall Notices UK is operated by Konstruction (UK) Limited (Company No. 08994748; VAT registration GB379993901; ICO registration ZC174464, as required of all UK data controllers under the Data Protection (Charges and Information) Regulations 2018). The data controller is Konstruction (UK) Ltd and the contact for any data-protection enquiry is hello@partywall-notices.co.uk.

Data we collect

  • Building Owner personal data (name, address, phone, email) entered into the wizard.
  • Adjoining Owner personal data (name, property address, correspondence address) entered by the BO.
  • Payment metadata (Stripe handles card data; we never see it).
  • Chatbot transcripts (when you choose to use the assistant).
  • IP addresses (hashed, used for fraud prevention and AO-letter visit logging).
  • Cookies — see our cookies policy.

Lawful bases

  • Contract — generating, storing and delivering your notice and reminder letter.
  • Consent — marketing emails and Tier 2 surveyor notifications that share your details.
  • Legitimate interests — fraud prevention, statutory record-keeping, Tier 1 anonymised surveyor notifications.

Surveyor nominations and the two-tier model

When the wizard nominates a surveyor we operate a strict two-tier notification model. Tier 1 notifications are sent to the nominated surveyor and contain only anonymised information — the notice type, the postcode area (e.g. “CT”) and the service date. No personal data is shared. Tier 2 notifications, sharing your name and contact details with the surveyor, are sent only with your explicit opt-in consent during the wizard. AO data is never shared with surveyors at this stage.

Third-party processors

International transfers

Several of our processors are based outside the UK: Stripe (Ireland and the United States), Resend (United States), Anthropic (United States), and Replit (United States, with database hosting through Neon in the European Economic Area). Where personal data is transferred outside the UK, transfers are made under the UK International Data Transfer Addendum (IDTA) to the EU Standard Contractual Clauses, or under a UK adequacy decision where one applies.

Retention schedule

Under UK GDPR Article 5(1)(e) we keep personal data only for as long as is necessary for the purpose for which it was collected. Our named retention periods, mapped to a UK GDPR Article 6 lawful basis, are:

  • Paid notices and associated consents — 7 years from the date of service. Lawful basis: Article 6(1)(b) (performance of contract) and 6(1)(c) (legal obligation — HMRC VAT record-keeping and the six-year limitation period under the Limitation Act 1980, plus a one-year buffer).
  • Adjoining-owner contact details captured in a notice — for the same 7-year period, on the basis of 6(1)(c) (compliance with the Party Wall etc. Act 1996, which makes valid service the BO's statutory duty).
  • Chat session logs and transcripts — 12 months, then deleted. Lawful basis: 6(1)(f) (legitimate interests — service improvement and abuse prevention).
  • Eligibility-checker leads that did not convert — 24 months, then deleted. Lawful basis: 6(1)(f) (legitimate interests — converting interest into a sale within a reasonable marketing window).
  • Marketing consent records — for the life of the consent plus 3 years after withdrawal, to evidence the lawful basis should the consent later be challenged. Lawful basis: 6(1)(a) (consent), and 6(1)(c) for retaining the proof itself.
  • VAT and accounting records — 6 years after the end of the relevant accounting period. Lawful basis: 6(1)(c) (legal obligation — Schedule 11 VATA 1994).
  • Soft-deleted accounts — 30-day grace period before hard deletion of dashboard access; underlying notice records are retained for the periods above where statutorily required.

Children

The service is not intended for under-18s. We do not knowingly collect data from children.
